Advocate for the plaintiff has not pressed draft
notice of motion. Hence draft N/M stands disposed
of as not pressed. It be registered for statistical
purpose. Today before the Court plaintiffs Babu
Nair and Preetha Nair are present. They have
submitted that matter is settled out of Court and
does not wants to continue with the suit so also
deft.no.1 Malti Hire, deft. no.2 Sameer Qureshi and
on behalf of deft.no.3 authorised person Edwin
Trindade are present. All the defendants do not
have any objection for withdrawal of the suit. Order
below Exh.5 Perused the application. Heard both
the sides. As in view of exh.6, the parties have
already settled their dispute out of Courts,
permission is granted to withdraw the suit.
Application Exh.5 is allowed and disposed of
accordingly. Order below Exh.1. In view of order
below Exh.5, the suit stands disposed of as
withdrawn. Case papers be filed. Court fees, if any
by refunded as per rules to the plaintiff.
