O R A L O R D E R
By the present application, the applicant is seeking transfer of
Charity Application No.12/2010 from C.R. no.2 to C.R. no.48 presided over by
learned Judge Shri M.T. Asim.
2 It is contended on behalf of applicant that the learned Judge Shri
M.T. Asim while he was presiding over C.R. no.2, heard the Charity Application
under caption fully and the matter was kept for orders. Meanwhile, assignment
was changed and learned Judge is presiding over C.R. no.48. Hence, the matter
under caption be transferred to C.R. no.48 presided over by Shri Asim.
3 The learned advocate for respondent appeared and submitted to
the orders of the court.

4 It appears that in the application under caption, both the parties
concluded the arguments. Rather, the arguments were lasted for about five days
and the matter was adjourned for order on 5th February,2020. In between the
learned Judge was designated as CBI Special Judge, and by administrative order
now he is presiding over C.R. no.48.
5 No doubt, the CBI Spl. Court has to deal with the CBI cases.,
however, in view of peculiar circumstance that five days have been consumed in
hearing and now matter is posted only for orders, to save judicial time and to
obviate a loss of productive judicial time in the circumstances mentioned above,
I think the mater which is only posted for order, can be transferred from C.R.
no.2 to C.R. no.48 where the learned Judge Shri M.T. Asim is presiding over the
court. Therefore, case is made out for transfer of the matter on administrative
side. In view of above I pass the following order:
O R D E R
1) T.A. no.37/2020 is allowed.
2) Charity Application no.12/2010 is withdrawn from C.R. no.2 and is
made over to C.R. no.48 for disposal in accordance with law.
3) Concerned courts be informed accordingly.
