ORDER ON NOTICE OF MOTION NO.3965/2018
	Perused Notice of Motion, affidavit in support thereof, documents filed by both the parties.
	Heard both the advocates at length.
	The plaintiff by way of this Notice of Motion prayed that the plaintiff be permitted to put tin shed / sheet and roof with asbestos sheets for covering the suit property i.e. admeasuring 3000 sq. ft. area. The plaintiff further prayed that the defendant be restrained from removing the belonging of the plaintiff from the demolition structure.
	Perused the entire documents on record filed by the plaintiff and defendant alongwith photographs. The record shows that the suit structure is affected in road widening project. The competent authority completed the procedure for annexture II. The said annexture II sale to SRA in the year 2016. The slum re-habitation scheme was also sanctioned. The plaintiff was called for the hearing. The Additional Collector Eastern Suburb pass an order against the plaintiff .
	The Additional Collector directed to issue notice to the plaintiff and other hutments. The plaintiff preferred the appeal before grievance Redressal Committee but the said committee also dismissed the appeal of the plaintiff. Accordingly demolition action took place on 16.10.2018. So the record shows that demolition of the suit structure took place on 16.10.2018 for road widening of Jawahar Road. If the plaintiff is permitted to put tin shed / sheet is nothing but giving go by to the demolition process and to the purpose of demolishing. The demolition of the structure took place by following due process of law.  Therefore, the plaintiff could not be permitted to construct the structure made up with the help of tin shed / sheets and roofs with asbestos sheet.
	The demolition process took place in the year 2018. The officers of the MCGM used to give notice, well in advance before demolition the structure so, as to remove their valuable articles from demolition structure. The officer of the MCGM or the  labour will not remove the bricks article patra from the demolition structure. If the said belonging is of the plaintiff then plaintiff will not require any permission of taking his belongings from the demolition structure therefore, in my opinion the relief prayed by the plaintiff could not be granted. The plaintiff has not brought on record sufficient material to grant relief mentioned in clause (a) and (b) of the Notice of Motion. Hence, I pass the following order.
