Today, matter is posted for hearing on Summons for Judgment. Matter was taken up for the hearing. During the course of hearing, it is found that only defendant No.2 had applied for leave to defend, though both the defendants had caused appearance through advocate Mr. Ganesh Patil by filing Vakalatnama. However, when lateron it is revealed to defendant No.2 that Vakalatnama was not filed within 10 days after serving the Writ of Summons, defendant No.2 took out the Notice of Motion for condonation of delay in entering the appearance and that motion was allowed and defendant No.2 then filed reply to Summons for Judgment for leave to defend the suit. Thus, only defendant No.2 had made valid and legal appearance for the purpose of the suit and not by defendant No.1, as Vakalatnama filed was not within the period of 10 days. On this background, ex-parte order against defendant No.1 was to be passed, but inadvertently it remained to pass. Hence, I proceed to pass the order.

Though the suit summons is duly served on defendant No.1, he failed to appear and therefore, the suit to proceed ex-parte against him. Partly heard Ld. Counsel for plaintiff on SJ Matter is adj to 15.07.2023 for SJ hearing.
