Heard both the sides on ad interim relief.
The defendant had issued a notice dated 4.2.2012 under Section
354A of MMC Act. Plaintiff had approached to this court by suit
no. 670/2012. Thereafter suit was disposed off and after that
speaking order is passed. In the speaking order dated 8.2.2019 it
has specifically mentioned that the structure is completed.
Therefore, now Section 354A of MMC Act is not applicable.
Defendant is at liberty to follow the due process of law. In view
of this suit and draft NM are disposed off. They be registered for
statistical purpose.
Sheristedar is directed to give authenticated copy of the roznama
to both parties.
