ORAL ORDER
This chamber summons is taken out by the plaintiff for
setting aside abatement order and bringing the legal heirs of deceased
plaintiff on record. The defendants has not objected for the same. The
copy of death certificate shows that plaintiff expired on 27/07/2017.

The delay in taking out the chamber summons is satisfactorily explained
in the affidavit in support of the chamber summons.
2. The main suit is for the cancellation of MOU. The right to
sue survives in the legal heirs of deceased plaintiff . Hence in the
interest of justice, I pass the following order.
ORDER
1. Chamber summons no. 232 of 2018 is allowed
and made absolute in terms of prayer clause (a) ,
(b) and (c)
2. The applicants to carry out the amendment within
two weeks and shall supply the copy of amended
plaint upon the defendants within two weeks
thereafter.
3. Chamber Summons is disposed of accordingly.
