ORDER BELOW CHAMBER SUMMONS NO.236/18
1. This Chamber Summons is taken out by the plaintiff for
bringing the legal heirs of deceased defendant on record.
2. The proposed legal heirs of defendant have resisted the said
Chamber Summons by filing reply on record. Read the application
and reply.
3. Heard. There is no dispute that the proposed defendant
no.1a to 1e are the legal heirs of deceased defendant Kamlesh
V.Shukla, who expired on 25/5/2017. Therefore, it is just and
desirable to bring the proposed legal heirs of deceased defendant on
record for the continuation of the suit. In the result, following order:
ORDER
1. Chamber summons no.236/18 is allowed.
2. The plaintiff is directed to bring the proposed legal heirs i.e. 1a
to 1e on record by way of amendment as per schedule on or before
next date without fail.
