favour of representative Mrs. Swati Desai issued by
National Insurance Co. The photocopy of Power of Attorney
is also filed on record with the application. The plaintiff
no.2 has also signed on behalf of plaintiff no.1. Ld. Counsel
for plaintiffs has also pointed out the letter of subrogation
and special Power of Attorney executed by plaintiff no.1 in
favour of National Insurance Co. Hence the application
Exh.18 is allowed. The plaintiffs are permitted to withdraw
the suit unconditionally. Suit is disposed of as withdrawn.
No order as to costs. Court fees be refunded as per rules to
the plaintiff no.2. Chamber summons or notice of motion, if
any, is disposed of as infructuous.
