Perused record. It appears that suit is filed on 13.02.2019
and it was adjourned for filing affidavit of service on
07.04.2020, 18.04.2020, 08.05.2020, 29.05.2020,
06.06.2020, 24.09.2020, 16.12.2020, 20.02.2021,
09.04.2021, 09.07.2021, 06.09.2021, 04.02.2022,
16.04.2022, 01.08.2022, 19.10.2022, 11.01.2023. On that
day plaintiff filed draft Chamber summons to carry out the
amendment and it was allowed and adjourned on
24.03.2023. On that day plaintiff sought extension of time to
carry out amendment and it was adjourned on 03.07.2023.
Even on that day, plaintiff again sought extension, which was
allowed subject to costs of Rs.1,000/- and adjourned on
21.08.2023 and 30.09.2023. On 30.09.2023 again plaintiff
sought extension of time to carry out amendment and
matter was adjourned on 21.10.2023. On that day, as
plaintiff had carried out amendment fresh writ of summons
is issued to the defendant and matter was adjourned for
filing affidavit of service on 22.11.2023, 16.02.2024,
25.04.2024, 09.10.2024, 06.01.2025, 25.03.2025,
14.07.2025, 08.09.2025, 04.11.2025 and 19.01.2026. On
19.01.2026 plaintiff was given last chance to file affidavit of
service. Today also plaintiff and his advocate are absent and
failed to take steps. Thus it appears that plaintiff is not
interested in conducting the matter. Therefore, no purpose
would served by keeping the matter pending. Hence, I
proceed to pass following order:-

Sum. Suit No.28 of 2020 is hereby dismissed in default.
