Perused Notice of motion, affidavit in support of it and reply to
draft NM. Defendant appeared in the matter on 28.11.2018. It
is contended by Defendant that notice of motion was served
upon Defendant on 15.11.2018. Considering the date of
appearance of Defendant before the Court, it can be said that
delay has been caused to filing written statement. Defendant
has shown sufficient cause for condoning the delay caused in
filing written statement. Even plffs have no objection for
condoning delay. Therefore I am of the view to condone the
delay caused in filing written statement by Defendant. Hence,
Notice of motion is allowed in following terms.
ORDER
1. Delay caused in filing written statement is hereby condoned.
2. Written statement filed by Defendant be taken on record.
