From the perusal of the roznama dtd. 06-02-2021 it appears that the defendant no. 1 presented his written statement with the contention that he was served with his writ of summons on 25-02-2020 and this Court was of the opinion that the written statement being not filed within the prescribed period of limitation, the defendant no. 1 will have to take out NM for condonation of delay. In this context it may be noticed that since it was the COVID Pandemic period the Honble Supreme Court has excluded the period of limitation till 31-03-2022 and hence, the written statement presented by the defendant no. 1 on record cannot be said to be filed beyond the period of limitation. Hence, the said written statement is taken on record and it is marked as Exh.7 . It also appears that though the defendant no. 2 appeared in the matter on 25-02-2020 he has not filed his written statement yet.
