By this notice of motion, the D-2 to 6 are praying for condoning the delay of 46 days in filing written statement.
It is stated in the affidavit filed in support of the notice of motion that the defendants contacted their advocates on 4.11.2017 and their advocate appeared in this suit on 6.11.2017. Thereafter their advocate sought inspection of documents from the plaintiff\''s advocate. However there was no response from the plaintiffs advocate. Hence there was delay in preparing the written statement.
The D-2 to 6 have explained the reasons for the delay and they have made out sufficient cause for condoning the delay of 46 days. Hence the notice of motion is liable to be allowed. However the plaintiff is entitled to receive cost for the delay.
