ORDER ON EXHIBIT-1
Kaushal Kumar Modi- Plaintiff present before this court who has
already filed the application for withdrawal (Exh-7) of the suit and
submitted that the present matter has been filed by the plaintiff for
possession of the car.
Against the order of this court of granting the interim order defendant
filed appeal in Hon’ble High Court Judicature, Bombay.
As per order dated 01/07/2019 passed by Hon’ble High Court,
plaintiff have deposited Rs.1,50,000/- and obtain physical possession of
the said car from the receiver of Hon’ble High Court. As the plaintiff has
receive the possession of the car he requested to withdraw the present
suit and withdrawn the amount of Rs.1,50,000/- deposited towards
security. Hence, plaintiff does not wish to proceed with and has decided
to the withdraw present suit.
Plaintiff, his advocate are present and submitted self attested copy of
Aadhar Card in support of his identity. Plaintiff submitted that the matter
is decided to be withdrawn. Plaintiff firmly states that he wants to
withdraw the suit against the defendant unconditionally. Hence, the
order.
ORDER
1.Suit No. 2547 of 2021 is hereby disposed of as withdrawn (Exh-7)
against the defendant unconditionally.
2. The PLA/concerned department of City Civil and Sessions Court,
Mumbai is hereby directed to pay Rs.1,50,000/- deposited on
11/07/2019 along with the interest if, any to the plaintiff, Kaushal Kumar
Modi.
3. Court fees be refunded as per the rules.
4.All the notice of motion, chamber Summons, application and misc.
application in connection with this suit shall be disposed of.
