When the plaintiff Adv submitted that the defendant Adv may be instructed to accept the SJ, Adv Avinash Pande refused to accept it contending that he has not filed VP on record.  I have perused the roznama in the proceeding.  True that VP does not appear to have been filed on record.  However, Adv Avinash Pande has been appearing in the matter since 27/03/2018 with contention that he represents the defendant.  Now at this stage it will be inproper on the part of Adv Avinash Pande to contend that as he has not filed VP, he cannot accept the service, because the roznama shows that he has already put in his appearance representing the defendant.  In any case, the roznama also shows that initially it was fixed for ex-parte evidence as per roznama dated 12/07/2018.  However, it reveals that the plaintiff has filed SJ on 04/02/2019.  Once the matter has proceeded ex-parte no need go to the SJ.  The plaintiff can directly file his evidence.  Hence, matter be fixed for ex-parte evidence.
