Read application and reply.  Heard.  By application (Exh.6), it is contended by DH/original plaintiff that JD no.1 to 3 filed first appeal and the JD nos.4(a) and 4(b) have not filed any appeal, therefore, the decree be made absolute and confirmed against them.  It is further contended by DH that the DH is ready and willing to execute sale deed of 1/4th share of JD nos.4(a) and 4(b). Therefore, the same be allowed.
The application is opposed by JD nos.1 to 3.  The application is misconceived and not maintainable under law.  The JD nos.1 to 3 have preferred the appeal and also sought stay before the Hon\''ble High Court.  The DH cannot seek execution of sale deed for 1/4th share of JD nos.4(a) and 4(b).  The suit premises is not partitioned.  The shares of the judgment debtors are not crystallized and by filing the instant application, DH seeks to determine the shares of JDs.
The decree speaks as under
1.  Suit is decreed with costs.
2.  Defendants are directed to perform their part of the contract by executing Sale Deed in respect of the suit flat upon payment of Rs.7,97,957/- by the plaintiff within a period of two months from this day.
     The decree does not contemplate execution of sale deed of 1/4th share by any of the deft. against whom the decree is passed.  It is also difficult to arrive at conclusion from the application (Exh.6) that the JD nos.4(a) and 4(b) are having 1/4th share.  The JD nos.4(a) and 4(b) have not preferred appeal but it would not be proper for this Court to travel beyond the decree.  This Court is executing Court and have to execute the decree as it is. This Court being Executing Court cannot modify the decree.  Therefore, granting permission and giving direction to the JD nos.4(a) and 4(b) to execute sale deed of 1/4th share would amount to overreaching the decree which is not permissible for the Executing court.  Hence, application (Exh.6) needs no consideration.  Hence, it is expedient to pass the following order.
ORDER
1.   Application (Exh.6) stands rejected.
2.  Application (Exh.6) is disposed of accordingly.
