The summons for judgment no. 268/2018 is
dismissed today with the findings given therein that in view of the order
passed by Hon’ble National Company Tribunal, Hyderabad Bench,
present suit is not maintainable here. Hence, in view of said order I hold
that present suit is liable to be disposed off as not maintainable.
Accordingly, following order is passed:
ORDER
1. Present Suit no. 294/2018 stands disposed off and
dismissed in terms of order passed below Summons for
Judgment No. 268/2018 as not maintainable.
2. The plaintiff is at liberty to pursue the claim submitted
before Ld. IRP appointed by Hon’ble the National Company
Law Tribunal, Hyderabad Bench.
3. Cost in cause.
