O R D E R
1. The petitioner has filed this petition to appoint her as a guardian
of minor Kshitij Santosh Kamble under section 8(2) of the Hindu Minor-
ity and Guardianship Act, 1956.
2. The brief facts of petitioner are as under;
Petitioner is the mother and natural guardian of a minor son
Kshitij Santosh Kamble. Kshitij Santosh Kamble born on 23.05.2007.
Petitioner's husband Santosh Sambhaji Kamble died on 23.11.2006,
leaving behind petitioner and minor master Kshitij Santosh Kamble,
aged about 17 years and daughter Miss Diksha Santosh Kamble born on

19.10.2005, aged about 19 years. The petitioner states that her mother
in law was employed with Mahanagar Telephone Nigam Limited,
Mumbai (in short ‘MTNL’). The said MTNL office issued a letter and the
said letter revealed that her above mentioned children were only enti-
tled to receive the dues of pension and gratuity of the deceased mother
in law. The petitioner stated that she be appointed as the guardian of
her two minor children namely (1) Diksha Santosh Kamble and (2)
Khitij Santosh Kamble. The petitioner will invest the amount of the
share of the minor and will use the same for his welfare. Hence, prayed
to allow the application.
3. Public notice and citation issued in daily newspaper. However no
one raised objection. Heard advocate for petitioner.
4. Master Kshitij Santosh Kamble is the son of the petitioner and he
was born on 23.05.2007. He is minor. Petitioner’s husband Santosh
Sambhaji Kamble died on 23.11.2006. Petitioner has filed her affidavit.
It appears that petitioner is natural guardian of minor. Her interest is
not adverse. Therefore, petitioner is the fit person to appoint as a
guardian of Kshitij Santosh Kamble. Hence, following order.
ORDER
1. The petitioner Smt. Vaishali Santosh Kamble is appointed as a
guardian of minor Kshitij Santosh Kamble or his properties under sec-
tion 8(2) of the Hindu Minority and Guardianship Act, 1956.
2. The petition is allowed and disposed off accordingly.
