I have carefully read the application. The plaintiff wants to the withdraw the suit after the allotment of the agency to deft. no. 2\''s brother-in-law by deft. no. 1 and the plaintiff wants to reserve his right to claim damages against the defts. for the said action. Considering above aspect leave is granted to withdraw the suit with permission to plaintiff to institute the fresh suit for damages against the defts. In respect of the subject matter of this suit.
