The plaintiffs have taken out the present C/S for amendment in the plaint. It is stated in the affidavit in support at the suit is for specific performance of the agreement. Plaintiff no. 1 who was the father of plaintiffs no. 2 and 3 died on 18-03-2020. After the demise of the said plaintiff no. 1. When the plaintiffs no. 2 and 3 search for the will if any left by their said deceased father, they found conveyance deed dtd. 25-10-1977 purportedly executed by the defendant in favor of Pushpa Chimanlal Mehta, the late mother of plaintiff no. 2 and 3 in respect of the suit property. The plaintiffs therefore would seek to amend the plaint with respect to the said fact of finding out conveyance deed.
Since the defendant despite substituted service by public advertisement in the daily newspaper did not enter appearance. Considering the matter which is not yet reached to the stage of trial, the amendment as sought for in the plaint will have to be allowed. Hence, I proceed to pass following order-
