Perused N/m which is supported by an affidavit.  Today before the court Jr.Engineer Mr.Aniket Bhokare is present.  It is an admitted fact that the MCGM was in receipt of reply on 22.01.2018(as reflected from document Exh.K page 82 of the plaint.) The officer present before the court submitted that no order is passed by the MCGM after receipt of reply dated 22.01.2018.  The record further shows that on 23.01.2018 the MCGM has issued notice under section 354 of MMC Act to which plff has filed reply to 25.01.2018 (as reflected from page no.100 of the plaint.)   As per order dated 25.01.2018 (page 118 Exh.N of the plaint) it shows that the speaking order was passed without considering the reply or the documents filed by the plaintiffs.  Be that as it may,  the MCGM is directed to consider both the reply and documents filed by the plff on
22.01.2018 and 25.01.2018 and shall pass the fresh order with regard to the notice structure.  The order so passed shall be communicated to the plaintiff in writing.  If the order is adverse to the interest of the plaintiff then no coercive action shall be taken by the MCGM for period of one week from the date of communication.  N/m No.397/18 is disposed of accordingly.

In view of order in N/m No.397/18, suit is disposed of accordingly. Suit be registered for statistical purpose.  It be removed from Board.
