ORAL ORDER
Perused chamber summons on affidavit. Heard advocate
for the plaintiff.
2. Ld. advocate for the plaintiff has sought relief of service as
per Order V Rule 20 of the Code of Civil Procedure 1908, stating that
registered A.D. packet issued to defendant no. 3 is received back with
remark “ not claimed” and there is no acknowledgement of the writ of
summons issued to defendant nos. 1 & 2. Hence, the present chamber
summons is filed.

3. Considering the endorsement and perusing
acknowledgement as alleged by plaintiff which was issued in the last
known address by defendant as contended by the plaintiff, this
application needs to be allowed. Hence, I proceed to pass following
order:
ORDER
1. Chamber summons is allowed.
2. The plaintiff is permitted to serve the writ of summons
through paper publication in two local news papers
widely circulated in the locality of defendant, one in
Marathi and another in English newspaper.
3. Chamber summons is disposed of accordingly.
