Heard adv for applicants on Chamber Summons No. 220/2020. Perused chamber summons and supporting affidavit. The chamber summons is taken out to bring on record the LRs of deceased plaintiff. The copy of death certificate annexed with the supporting affidavit shows that plaintiff died on 15.11.2019. The draft chamber summons is tendered on 23.01.2020. Defendants are served with chamber summons but they have not filed reply. The chamber summons is filed within limitation. The cause of action survives to the Legal heirs. Therefore, chamber summons deserves to be allowed. Hence, following order is passed
Order
1. Chamber Summons No. 220 of 2020 made absolute in terms of prayer clause (a) and (b).
2. Applicants to carry out amendment in the plaint within 14 days and shall tender the copy of amended plaint on record as well as to serve upon adv for defendant.
