to the plaintiff and to the applicants in Ch/s no.214/2018 to
file additional reply / documents before the concerned
authority within one week from today. The concerned
authority to hear both the sides and pass the fresh speaking
order in relation to the notice structure. The speaking order
so passed shall be communicated in writing to plaintiffs and
applicants in Ch/s No.214/18. If the order is adverse to the
interest of the plaintiff then no coercive action will be taken
for period of one week from the date of communication of
speaking order. Notice of Motion No.369/18 stands
disposed of accordingly. Order in Ch/s No.214/18 In view
of order in N/m No.369/18
no purpose would be served in keeping the Ch/s pending.

Order below N/m No.369/2018 Perused N/m which is
supported by an affidavit. Till the date the MCGM has not
filed any reply or documents on record. Dharmendra Mhatre
and others have taken out Chamber summons no.214/2018
for adding them as party to the suit. I have heard the
Ld.advocates of both the parties. Without going into the
merits of N/m , Ch/s and the suit, it is pointed out that after
passing of the speaking order, the plaintiff has made the
representation /reply through his advocate on 09.01.2018
(Copy of which is at Exh.N, page 66 of the plaint.) The said
reply shows the acknowledgment of MCGM.As certain
documents are filed along with the said representation,
