The counsel for plaintiff has filed an application below
Exh-9 for withdrawal of summary suit. POA of plaintiff and
his advocate are present. POA of plaintiff submitted that
defendant has agreed to pay an amount of Rs.8,00,000/-
towards full and final settlement. Therefore, plaintiff does
not want to proceed with the matter.
In view of the submissions of POA of plaintiff and his
advocate as well as contents in the application for
withdrawal of the suit at Exh-9 and as per terms and
conditions in agreement dated 21.06.2024 executed between
the parties, the suit No. 827 of 2015 is hereby stands
disposed of, as withdrawn unconditionally.
Pending Notice of motion No.349/18 and Summons for
judgment No.158/2017 is disposed of accordingly.
The plaintiff may be entitled to refund of court fees, if
provided for in the rules.
