He pointed that the defendant failed to file reply to Summons for Judgment, hence, plaintiff is entitled for decree in terms of order 37 Rule 3(6)(a) of CPC.
F.R.S.R. following order is passed-
ORDER
1.Summons for Judgment No.19 of 2018 in Summary Suit No.1431 of 2017, is hereby allowed.
2.Summary Suit No.1431 of 2017, stands partly decreed with costs.
3.Defendant is directed to pay the plaintiff a sum of Rs.25,75,000/- within two months from the date of this order, failure to which the amount shall carry interest at the rate of 9 percent per annum from the date of filing of suit, till its full realisation.
