It is noted that there is typographical mistake in operative order
in roznama of Short Cause Suit No.1081 of 2018. At the time of
typing roznama and uploading the same, inadvertently in Clause
1 “The suit is partly decreed with costs” is recorded in the
operative order instead of “The suit is decreed with costs”. In
Clause2 it is inadvertently types as “from 29/07/2015” is
recorded instead of “from the date of filing of the suit”.
Section 152 of the Code of Civil Procedure, empowers the Court
to amend any defect or error in the proceedings or in the suit.
Therefore, the earlier incorrect operative order is deleted and
corrected operative Order in the roznama as under:
O R D E R
1. The suit is decreed with costs.
2. Defendant is directed to pay the amount of Rs.2,55,062.68
to plaintiff along with interest thereon at the rate of 12.95% per
annum from the date of filing of the suit till realisation of the
total decreetal amount within 60 days from the date of this order.
3. Decree be drawn accordingly.
4. Court fee be refunded to the plaintiff in appropriate
proportion and as per the entitlement.
5. Short Cause Suit No.1081/2018 is disposed of accordingly.
