ORDER
1. Chamber Summons No. 259 of 2019 is made absolute in terms of prayer clause (a).
2. The Plaintiff/Decree Holder is permitted to carry out amendment, as prayed within two weeks, from the date of this order.
3. Chamber Summons No. 259 of 2019 stands disposed of accordingly.
Application tendered by J/D no. 1 for seeking stay order to order passed in Ch/s no. 259/19. t.o.r. It seems that this Ch/s has been taken in execution application for executing the decree. It appears that the decree has been confirmed in second appeal. There is document in view of agreement referred in the decree for giving permanent alternate accommodation and accordingly it appears that flat no. 102 has been alloted to the decree holder. Already possession warrant has been issued and WP filed for challenging the said order has been dismissed. In the circumstances, it is not just to pay the present order. Hence application is rejected.
Matter is adjd. to 27.06.2019 for compliance by the Plaintiff.
