Order passed in Ch/s no. 172/18 Heard. Perused affidavit in
support of Ch/s. It appears that present Ch/s has been taken by
the plaintiff for brining on record curtain fact which remained
to be impleaded in the plaint and curtain subsequent events
taken place after filing of the suit. The suit is filed for seeking
relief of declaration in pursuance to the letter issued by deft
no. 1 dtd 23.06.2012 in respect of suit flat and also the plff has
sought consequential reliefs in pursuance to the said letter dtd
23.06.2012. It appears that after filing of the suit, deft no. 1
executed registered Power of Attorney in favour of present
respondent for redevelopment of the suit building and
accordingly present Respondents have returned a letter dtd
16.07.2016 to the present plaintiff and even they have
obtained IOD. In the circumstances, considering the reliefs
claimed by the plaintiff in respect of suit subject, it is just and
proper to allow present Ch/s as prayed. Thus, Ch/s is to be
made absolute in terms of prayer clause (a) and (b). with this I
proceed to pass the following order. Order 1. Chamber
Summons No. 172 of 2018 is made absolute in terms of (a)
and (b). 2. The plff is directed to carry out amendment as per
the schedule annexed to Ch/s on or before next date and
further directed to place on record amended copy of the suit
plaint and serve the same to deft nos. 1 to 7. 3. The plff is
further directed to issue writ of summons to newly added deft
nos. 8 to 10 4. Accordingly Ch/s no. 172 of 2018 stands
disposed of. Matter is adjd. to 12.12.2018 for compliance by
the plff/ N/M hearing.
