for defendant present. Parties have settled the matter in the
following terms. 1. Flat bearing No. C/21, Prbhukripa Co-
operative Housing Society, Nanda Patkar Road, Vile Parle
East, Mumbai-57 has occupied by the defendant will by
sold to any party agreed by them. 2. In case any one of the
plaintiff or the defendant bid better price of the agreed price
will be sold to him. The defendant Sudhakar was residing
since more than 50 years. Preference will be given to him to
purchase the flat. 3. The process of transfer of flat will take
place after the possession of the flat is given to the
defendant Mr. Sudhakar Dattatray Pawaskar. This process
will take place after possession of flat is taken by Sudhakar
after one month. This time is required for inspection of flat
by the defendant. The defendant will not make ony third
party agreement with any purchase in mean time. 4. The
share of the defendant is 1/3 and the share of each of the
plaintiff is 1/6 and their total share is 2/3 in the sale of the
flat. The statement terms are accepted by the both parties
and recorded. Award be passed in terms of Exh.4. Decree
be drawn up accordingly. Court fees, be refunded, if any, to
the plaintiffs, as per rules.
