Perused application, reply and heard advocate for the parties.
The defendant has taken out this application for stay of order passed in
notice of motion no.554 of 2018 for period of 8 weeks. It is submitted
that defendant wants to challenge order passed in notice of motion
no.554 of 2018. Vide order in notice of motion no.554 of 2018 the
defendant is restrained from obstructing the right of plaintiff to use lift
facility in the suit building. Admittedly, plaintiff was not utilizing lift
facility after filing suit till the order was passed in notice of motion
no.554 of 2018. Considering the nature of pleadings and the allegations

made by defendant against the plaintiff it is just and necessary to stay
the execution and implementation of order passed in notice of motion
no.554 of 2018 for period of 4 weeks. Hence following order.
ORDER
Application is allowed.
2. Order passed in notice of motion no.554 of 2018 is stayed for
period of 4 weeks from today.
