1. This notice of motion is moved by the defendants for condonation
of 91 days delay in filing written statement.
2. It is stated in the affidavit that the defendants were unable to give
instructions to their Advocate as they had gone to their native place to
see their Aunt, who is bed ridden. Hence, there is delay of 91 days.
3. It appears that the defendants were not negligent in prosecuting
the matter and the delay has occurred due to unavoidable
circumstances. Hence, they can be permitted to file written statement.
However, they are liable to pay cost. Hence, following order.
ORDER
1. Notice of motion no.323/2018 is made absolute in
terms of prayer clauses (a) & (b) subject to payment of
cost of Rs.1,000/ to the plaintiff within two weeks from

today.
2. If the cost is paid, written statement of defendants be
taken on record.
3. If the cost is not paid, Notice of motion no.323/2018
shall stand dismissed.
