The plaintiff has taken out the Chamber Summons to carry out the amendment in the plaint and proceeding.
Perused chamber summons, affidavit in support there of. Heard advocate for the plaintiff. Defendant neither filed reply to the chamber summons nor argued the same, hence chamber summons taken up for order.
The plaintiff taken out the chamber summons for deleting the name of defendant no. 2 Mrs. Laxmi @ Radha Anand Waghchaure in the title clause of plaint as being died on 10/09/2021. The contention of plaintiff that the heirs  of defendant no. 2 are already on record and they are party to the suit.  Thus in my opinion considering the nature of amendment it can be allowed as the nature of suit did not change and there is no hardship cause to any party, therefore plaintiff is entitled for relief prayed. Considering this I passed following order:-
1) Prayer clause (a) of chamber summons no. 1444 of 2022 is made absolute.
2) Plaintiff is directed to carry out amendment within stipulated period.
