It appears from the record that the Suit No.7720/02 was dismissed in default on 18-02-2014 and as per order in Notice of Motion No.958/14, the suit came to be restored subject to payment of costs of Rs. 6,000/- to the defendant and carrying amendment as per order in roznama dated 02-11-2018. ORDER
1.Notice of Motion No.488 of 2019 in Suit No.7720 of 2002 (Disposed of), is hereby allowed subject to payment of costs of Rs.10,000/- to be paid to defendant No.1 within one month from the date of this order.
2.Plaintiff is also permitted to pay the costs of Rs.3,000/- to defendant No.1 as per the order in notice of motion No.958 of 2014, within one month from the date of this Order.
3.Delay stands condoned after payment of costs of Rs.10,000 and Rs.3,000/- i.e. Rs.13,000/- and Suit No.7720 of 2002 stands restored.
