O R D E R
1. Defendant No.1 taken out this N/M under order 7, rule 11(d) of the Civil Procedure Code for rejection of plaint on ground that suit is barred by limitation. It is contended that as per the plaintiff\''s own case cause of action arose when defendant No.1 failed to execute development agreement in favour of the plaintiff. The cause of action to seek specific performance of the contract arose in April, 2012 and period of more 8 years has gone. Therefore, the suit for specific performance of contract is bared by limitation. Therefore, plaint be rejected.
2. Plaintiff filed reply and opposed N/M.
3. Heard Adv. for parties and perused record. This is suit for permanent injunction restraining defendant No.1 entering into development agreement, alienating or partying with possession of the suit property or creating third party interest. The defendant taken out this N/M for rejection of plaint on ground that relief of specific performance is bared by limitation. However, present suit has not been filed for relief of specific performance. Therefore, N/M for rejection of plaint on ground that relief of specific performance is bared by limitation is devoid of merit. The plaintiff relied on judgment of Hon\''ble Bombay High Court in the case of Jyotsna K. Walia V/S T. S. Parekh and Co. However, in the said case issue before the Hon\''ble High Court was relating to leave to defend in Summary Suit. Therefore, judgment relied by the plaintiffs is not applicable to the facts of the case in hand. In the circumstance, N/M deserves to be dismissed. Hence, I passed following order-
