in Ch/s No. 177/20. Heard. Ld. Counsel for the pltff
submitted that the deft no.1 and 2 could not be served with
writ of summons. He would submit that the attempts were
made to serve writ of summons at there last known address
but the defts are avoiding the service. Hence, the pltff wish
to serve the deft by substituted service. On Perusal of the
record it appears that the defts could not be served at the
address mentioned in the plaint. Even the attempt was made
to serve the Ch/s to the deft no.1 and 2 but the postal report
suggest that the address incomplete. In this background the
pltff has made out the case for substituted service hence it is
expedient order passed following order. ORDER 1. Ch/s is
made absolute in terms of prayer clause (a) 2. Plaintiff to
serve writ of summons to the deft no.1 and 2 by affixing the
copies of writ of summons at the notice board of this court
and at the Sheriff Office and at the house of the deft no.1
and 2 were they have last resided and carried their business.
3. Plaintiff to serve writ of summons by advertisement in
daily newspaper widely circulated in the locality in which
the deft last resided and carried their business. 4. Fresh writ
of summons is issued to serve defendant no.3 to 5.
