By this chamber summons, the applicants have prayed for bringing their names of record in place of the original plaintiff who expired on 7.2.2017. One chamber summons was initially filed in April 2017 for same relief. However, that was withdrawn with liberty to file a fresh chamber summons in view of some mistake in the names of parties. The present chamber summons is filed on 22.1.2018. Since the first chamber summons was filed within time, the present chamber summons has to be allowed. However, the applicants are liable to compensate the defendants by paying cost. Hence Chamber summons no.149/2018 is allowed subject to payment of cost of Rs.2000/- to defendants within two weeks, failing which the chamber summons shall be dismissed.
