    This N/M is taken out by deft. praying to condone delay of 26 days in filing reply to summons for judgment.
       Perused the affidavit filed along with N/M and say of plaintiff.
        It is submitted on behalf of deft. that plaintiff served copy of summons for judgment to defendant\''s advocate on 08.09.2021 by post.  Deft. was hospitalized from 23.08.2021 to 01.09.2021 and he was advised for complete bed rest.  Therefore, deft. could not apply for leave to defend within stipulated period.  By making these submissions, deft. prayed to condone the delay in applying leave to defend the suit.
      It is submitted on behalf of plaintiff that deft. has not given sufficient cause.  If the Court inclines to condone the delay, heavy costs may be imposed on deft.
      Considered the submissions advanced on behalf of both sides.  On 03.09.2021, plaintiff tendered draft S/J. Leave to register S/J was granted on that day and matter was adjourned to 06.10.2021.  On that day, deft. sought adjournment for filing reply to S/J. However, that application was rejected as stipulated period for filing reply to S/J was already over.
     It is not in dispute that S/J was served upon defendant\''s advocate on 08.09.2021.  Deft. submits that he was admitted in hospital from 23.08.2021 to 01.09.2021 and thereafter, doctor advised him for the bed rest.  Defendant\''s claim is well supported by copy of discharge summary filed on record.  Deft. has taken out present N/M by taking out preceipe on 14.10.2021.  He has given sufficient cause which prevented him from applying leave to defend the suit.  Therefore, it would be expedient to excuse the delay of the deft. in applying for leave to defend the suit.  Considering the short period of delay, it would not be just and proper to impose costs upon deft.  In the result, following order.
ORDER
1.   N/M No.2502/21 is made absolute in terms of prayer clause (a).
2.    No order as to costs.
3.   Reply to summons for judgment i.e. leave to defend the suit filed by deft. be taken on record.
