The plaintiff has taken out this Chamber Summons for seeking correction in the name of the defendant in cause title of the suit as per schedule I and II. It is submitted that the name of defendant no. 2 has been wrongly typed as -Shashkant- instead of -Shashikant- in the cause title of the suit. Similarly the surname of defendant no. 2 has been wrongly typed as -Chandaran- instead of -Chandarana- as shown in Schedule I and II annexed with draft Chamber summons.
Ld. counsel for plaintiff has also produced photocopy of identity card issued by Election Commission and Passport of plaintiff. I find that draft CS is supported by affidavit of plaintiff and photocopy of ID proof issued by Election Commission of India and Passport Authority, for seeking correction of typographical error. Hence, in exercise of powers under section 152 and 153 of CPC the draft CS is allowed and plaintiff permitted to carry out necessary correction in the name and surname of defendant as prayed in CS within one week from today and shall submit amended copy of plaint, thereafter as per procedure.
Plaintiff to do the needful and comply.
Draft CS is disposed of accordingly. Office to register the CS for statistical purpose.
