ORAL ORDER
1) The chamber summons is filed by applicants to allow
them to contest the suit being legal heirs of deceased plaintiff.
The chamber summons is supported by affidavit of applicant No.
1 Surekha Gaddime. She on oath stated that the applicants are
the only legal heirs of deceased. Hence prayed to allow the
application. The suit is filed by deceased plaintiff for recovery of
money from defendants.
2) The defendant has no objection to bring on record
the legal heirs of deceased plaintiff. The xerox copy of death
certificate shows that the plaintiff expired on 28/09/2018. The
application is filed on 06/12/2018. The applicants desire to

contest the suit. The suit is for recovery of the money from the
defendants. The applicant are the legal heirs of the deceased
plaintiff. Hence Chamber summons needs to be allowed. Hence
pass following order.
ORDER
1. The Chamber summons is allowed in
terms of prayer (a).
2. The applicants are directed to
carryout necessary amendment within
limitation.
3. Accordingly Chamber summons is
disposed of.
