O R D E R
This chamber summons is taken out by the applicants for taking
their names on record after deleting the name of deceased plaintiff. This
chamber summons resisted on behalf of the defendant Corporation.
Read the present chamber summons, affidavit of the applicant no.2
Mohan Gangaram Taral in support of this chamber summons, reply of
the defendant Corporation. Heard both the learned counsels on behalf
of both the sides at length. Perused the record.
2. On scrutiny of the pleadings of both the parties, it is not disputed
that the Vasanti Bhanudas Taral i.e. original plaintiff has been filed the
present suit against the Corporation. During pendency of the suit, the

plaintiff died on 25/09/2018. The death certificate of the plaintiff is
produced to that effect. Admittedly, the present chamber summons
came to be filed by the plaintiff on 16/01/2019. Considering the
reasons mentioned in this chamber summons and affidavit of the
applicant no.2 Mohal Gangaram Taral, the present chamber summons
needs to be allowed. Therefore, I proceed to pass following order.
ORDER
1. Chamber summons No.213/19 is hereby allowed as prayed for.
2. The applicants and their advocate are hereby directed to carry out
proposed amendment within stipulated period.
3. Chamber summon No.213/19 is disposed off accordingly.
