order of the court. ORDER below Chamber
summons No. 160 of 2020 The chamber summons is
filed by plaintiff to amend the plaint as per schedule
annexed to chamber summons. The chamber
summons is supported by affidavit of Ashish
Surendra Gupta plaintiff No.1 (d). Plaintiff stated
that defendant No.1 expired on 18.11.2019. The
xerox copy death certificate is annexed to affidavit.
The suit is filed for restraining defendant NO. 1 and
2 by perpetual order and injunction to execute
agreement in favour of defendant No.3 and or
transfer any development rights of property. The
legal heirs of deceased defendant are already on
record therefore amendment in plaint is sought only
to the name of defendant no.1. The defendant has
left it to court to decide the chamber summons. The
chamber summons is filed on 28.01.2020. The
chamber summons is filed within limitation hence
pass following order ORDER 1. The Chamber
Summons is allowed. 2. Prayer (a) of chamber
summons is made absolute with direction to note in
front of the title clause defendant No.1 as deceased.
3. Plaintiff to carryout amendment within limitation.
4. Accordingly, chamber summons is disposed of.
