Heard Ld. Advocate for DH. The pursis Exh.8 filed by the Ld. Adv for the DH on 24.06.2022 shows that Appeal from Order No.671/2019, filed against the order dated 04.01.2019 in NM No. 1778/2016 is dismissed by the Honble High Court vide order dated 29.04.2022. The said NM was filed by JD No. 1 and 3 to set aside exparte decree in Suit No 4587/2009 and for other reliefs.
Ld. Adv for the DH submitted that in Writ Petition No. 9667/19, third party i.e. father of defendant No.2 had challenged the warrant of attachment and on the submission of Advocate for DH that the decree will not be executed against the petitioner in respect of the property at 601, Triveni Sangam, adjoining to the Jaslok Hospital, 15A Peddar Road, Mumbai 26), the Hon\''ble High Court has given liberty to the DH to proceed in respect of other parties and other properties.  Record shows that three immovable properties are attached on 01.04.2016. Out of these properties, DH does not want to proceed in respect of the property at Peddar Road, as submitted before the Honble High Courtin Writ Petition No.9667/19. So far as the other two properties are concerned which consists of 601, Anand Bhuvan, East Avenue, Santakruz (West), Mumbai and 71, Diamond Queen, West Avenue, Santakruz (West), Mumbai,  it is pointed out by the Ld. Adv for DH that there is no legal impediment to proceed in execution in respect of the said properties.
I have perused order dated 16.10.2019 in Writ Petition No.9667/19 and order dated 29.04.2022 in Appeal from Order No. 761/19.  It is seen that there is no legal impediment to proceed in respect of the above two properties, which are already under attachment.  Thus, warrant for sale of the properties situated at  601, Anand Bhuvan, East Avenue, Santakruz (West), Mumbai and 71, Diamond Queen, West Avenue, Santakruz (West), Mumbai, be issued under Order 21 Rule 64 of CPC and the said properties or such portion thereof as may seem necessary to satisfy the decree, shall be sold and proceeds of such sale shall be pay to the DH.
