ORDER
This is a notice motion taken out by the defendant no. 1
and 2 for accepting their written statement by condoning delay.
This notice of motion resisted on behalf of the plaintiff bank by
filing its reply on notice of motion itself.
2. Read the notice of motion, affidavit of the defendants in
support of notice of motion and Reply of the plaintiff thereon.
Heard the learned counsel on behalf of the plaintiff. Advocate for
the defendant was absent at the time of arguments.
3. On perusal of the reply filed on behalf of the plaintiff bank
on notice of motion taken out by the defendant nos.1 and 2 is not
strongly opposed. It simply opposed in its reply. On scrutiny of the

notice of motion, in support of affidavit of the defendants,
considering the nature of the suit, it appears to me that
opportunity should be given to the defendants for filing their
written statement by condoning delay. Therefore, I inclined to
allow this notice of motion. Hence, I have proceed to pass
following order.
ORDER
1. Defendant nos. 1 and 2's notice of motion no. 400/2019 is
hereby allowed as prayed for.
2. The defendants nos.1 and 2 are hereby directed to file their
written statement on or before 11/03/2020.
3. Notice of motion no. 400/2019 is disposed of accordingly
