ORDER ON DRAFT NOTICE OF MOTION
The plaintiff seeks ad-interim temporary injunction restraining the defendant from acting upon the notice dtd. 11/01/2019 and the order dtd. 09/01/2020.
The schedule of the notice read as under
1) Unauthorized construction of shed at ground floor at entrance of bldg. towards northside by way of using M. S. angles and roof covered with G. I. Sheets admg. 4.50 mt. x 2.10 mt x 3.50 mt.
2) Unauthorized construction of shop at ground floor on compulsory open space by using MS angle ladi coba slabs, brick masonry walls, enclosed with M. S. rolling shutter admg. 4.50 mt x 2.45 ml x 4.10 mt. Mezzanine floor admg. 3.50 x 2.45 x 2.10 mts.
3) Unauthorized horizontal extension at 6th floor flat no. 601 north side window extended with cantilever gallery to window by way of using m s angles and m s grills admg. 5.50 x 1.00 x 2.10 mts.
4) Unauthorized construction entire flat on 7th floor by way of using b m walls m s sheet partition walls, roof covered with ladi coba ladi slab. It used for residential purpose admg. 5.50 x 10.20 x 3.10 mts.
5) Unauthorized horizontal extension at 8th floor level on northside of bldg. vertical extension work by way of using ladi coba ladi slab, brick masonry walls, admg. 2.90 x 3.50 x 4.80 mt at sadat tower, 35 bora street, Mumbai 03 work carried out without taken prior permission from competent authority I.e Municipal Corporation of Gr. Mumbai.

The Plaintiff had replied the notice. The plaintiff had submitted payment receipt dt. 12/04/2017, Bill of property 2016-2017, Rent receipt dt. 01/01/2007, License by Corporation dt. 04/09/2014, Registration Certificate 31/01/2017. Rent receipt dt. 01/01/2017, Electricity bill dt. 01/01/2019, Ration Card, Aadhar Card, Notice of assessment dept., Annexure-A of assessment dept. dt. 22/05/2015.
It is contented by the plaintiff in the reply that the building is redeveloped in the year 2006. The constructions mentioned in the schedule serial no.1 to 5 are in existence since the date of construction of the building. It is submitted the construction of alleged 8th floor is submitted that the flat on the 7th floor is a duplex flat spread over two floors.
In the speaking order it is observed by the corporation designated officer
1) Permission/approval from competent authority i.e. Executive Engineer (Building proposal) City-III of MCGM for notice structure.
2) Documents showing the existence of structure prior to 01/04/1962 for commercial structure and 17/04/1964 for residential structure which is a datum line to be considered in tolerated category for notice structure which a datum line to be considered in tolerated category for notice structure.
It needs to be noted that the plaintiff has submitted in the reply to the notice that the building is re-developed in the year 2006. The plaintiff had not submitted the Sanction Plan along with it\''s reply. Admittedly, the plaintiff had not submitted the permissions obtained from the corporation for carrying out the construction mentioned in the schedule of the notice. It is for the plaintiff to show that the notice structures existed from the year 1962 or 1964 that is the datum line for commercial and residential premises. The documents filed along with the reply do not show that the notice structure were assessed from 1962 or 1964 till date or the documents show the existence of notice structure prior to 1962-1964.
The plaintiff had failed to show that the notice structures were constructed with the prior permission of the corporation and also had failed to show that the notice structures existence prior to the datum line.
The plaintiff had failed to make out prima facie case in his favour. The balance of convenience does not lie in favour of the plaintiff. The plaintiff would not be put to irreparable loss. In result, the following order.
