Perused Chamber Summons and Affidavit in Support.
Heard Ld counsel for plaintiff.
It is submitted by the plaintiff bank that the concerned
officer who had filed suit met with an train accident and lost his
life. In this circumstances, plaintiff is unable to file affidavit in
examination in chief of concerned officer and therefore, it is
necessary to incorporate name of new Officer Ajt A.Puranik in
place of Mr.Arvind Y.Desai. Admittedly, plaintiff is financial
institution and after demise of Mr.Arvind Y.Desai it is necessary to
the plaintiff to incorporate name of new officer Mr.Ajit A.Puranik
to proceed which suit and because of demise of earlier officer

Mr.Arvind Y.Desai plaintiff want to carry out amendment to
incorporate name of Mr.Ajit A.Puranik as a plaintiff. After
considering the reason, I found that the present amendment is
formal in nature and if permission is granted to incorporate the
name of present officer Ajit A.Puranik in the clause title then no
prejudice will be caused to the case of defendant. In the above
said reason I proceed to pass following order.
ORDER
1) Chamber Summons No.148 of 2020 is made absolute in
terms of prayer clause (a) and (b).
2) Plaintiff is directed to carry out amendment within 14 days.
