ORDER
1. The plaintiff has filed instant Chamber Summons for
addition of official liquidator as the party to the proceeding.
2. It is submitted by the plaintiff that they have filed Company
Petition CP No. 187 of 2015 before Hon'ble Bombay High Court for
winding up of the Defendant No. 1. The Hon'ble High Court on
14.06.2016 appointed financial liquidator. Therefore, the financial
liquidator needs to be brought on record for the purpose of further
proceedings.
3. I find substance in the application. The record shows the
official liquidator is appointed for Defendant No. 1. Hence, Plaintiff
allowed to add official liquidator. Thus, I proceed to pass the following
order.
ORDER
1. Chamber Summons No.164/2019 is made absolute in terms of
prayer clause.
2. The plaintiff is allowed to amend the plaint forthwith.
2. Chamber Summons No. 164/2019 disposed off accordingly.
