Adv. Mr. Mohit Jadhav for the plaintiff is present. He submitted that
in view of the instruction, the structure stated in impugned notice is
demolished. He also invited attention to such recital of the NM
reply/written statement filed by the defendant/MCGM and
submitted that the matter may be disposed of. Adv. Mr. Swapnil
Bharti h/f Adv.Ms. Nagarthawar for defendant/MCGM is present.
He submitted that the structure is already demolished and therefore
the suit has become infructuous.
Order Below Exhibit No. 01:
In view of the above referred statement, the suit stands
disposed of as it has become infructuous on demolition of the
structure. All the pending applications including NM No. 344/2020
stands disposed of and filed. The parties to bear their own costs of
the litigation. Bill of costs be drawn-up accordingly.
The Original documents filed on record be returned to the
respective parties, on their submitting its Certified Copies, if the
documents are exhibited, or Self-attested True Copies, if the
documents are not exhibited, along-with undertaking to furnish the
originals as and when required by the Court. The concerned
Department to do the needful. The proceeding is closed.
