 Heard. Perused documents. It appears that the builder has made construction of the suit building on the Govt. Land and the builder has obtained the loan from State Bank of India i.e Defendant no. 2 for construction of the suit building. It is submitted by Ld adv for the Plaintiff that Defendant-15 to 19 are the partners of Mahalaxmi Developers, who have constructed the suit building wherein suit flat situate. He has pointed out that the builder has obtained the loan from Defendant no. 2 and at that time, Bank\''s advocate and developer\''s advocate has given title clear certificate in respect of the suit land and the bank has granted loan to the builder for the construction of the suit building. It seems from 7/12 extract of the suit land that in other right column, there was necessity to obtain prior permission of the competent authority for the transfer of the suit land and suit land is occupancy class-II land.
         In this background, after the construction of the suit building, the Govt. has issued notice dtd 31.08.2018 to the Chairman of the society of the suit building for recovery of 14,42,75,160/- in view of three times transfer of the land unauthorizely i.e transfer without taking previous permission of the competent authority. Further it reveals that present Plaintiff, who has purchased flat in the suit building has also obtained loan from the same Bank and the Bank has considered at that time, clear title of the suit property, as already the same bank has approved project of the builder, who has constructed the suit building and sanctioned loan to the builder.
         It Prime facie, seems that the bank has issued notice to the Plaintiff under SARFAESI ACT and even on 20.07.2019, order has been passed against the Plaintiff. It is submitted by Ld adv for the Plaintiff that the builder, the bank and Govt. Officials in collusion acted fraud upon the Plaintiff. According to the Plaintiff, in view of recovery notice by the Govt. Authority dtd 31.08.2018, the Plaintiff has stopped the payment of installment of his loan amount, as he came to know about the fraud acted upon him. Further the adv for the Plaintiff has drawn my attention toward exh. (I) to the plaint. It appears that the Plaintiff has given request letter to the bank in respect of recovery of loan amount, in view of defective title of the suit property.  According to the Plaintiff, as the Bank has acted upon the title report of adv for the builder and adv for the bank and even upon relying the same disbursed loan to the Plaintiff, it is nothing but fraud upon the Plaintiff. In the above background, prime facie, it appears that there is substance in the arguments of the Plaintiff in respect of alleged fraud acted upon him while purchasing the flat from the developer and while obtaining the loan from the Bank. Prime facie it appears that order passed u/S 14 of SARFAESI Act was obtained fraudulently and therefore, it is just, in the interest of justice to grant status-quo in respect of suit flat till next date. Hence the defts are directed to maintain status-quo in respect of suit flat till next date.
The Plaintiff is directed to comply O-39 R-3 of the CPC.
The date is preponed to 4.10.2019 and accordingly issue writ of summons and notice in respect of N/M to all the defts through bailiff of sheriff office and simultaneously by RPAD post or speed post on payment of process fee.

I have verified roznamas of both dates.  It appears plaintiff intially filed draft notice of motion no.29.08.2019, he took it for registration . I came to be registered as notice of motion no.3336/2019. Unfortunately before he could submit registered notice of motion no.3336/2019 to Court, he lost it. Therefore on 16.09.2019, he filed a fresh draft notice of motion with same reliefs. My learned predecessor heard that notice of motion on 17.09.2019 and passed status-quo order on that draft notice of motion. Later on it was registered as notice of motion no.3568/2019. In these circumstances notice of motion no.3336/2019 should have been shown as disposed off but it is still pending in CIS. Hence, I pass following order
