O R D E R
This chamber summons is taken out by the applicant for
deleting the name of applicant no.2 in main chamber summons no.
1727/15. Read the present chamber summons and reply given by the
plaintiff and the defendant no.2.
2. By way of this chamber summons, the applicant wants to
delete the name of the applicant no.2 from chamber summon no.

1727/15. During the pendency of the said chamber summons, applicant
no.2Smita Chandrashekhar Kusurkar was murdered on 12/07/2018.
ExhibitA and ExhibitB is attached showing applicant no.2 was
murdered. Therefore, it is necessary to delete the name of applicant
no.2 in the main chamber summons no.1727/15. Admittedly, If the
chamber summons is to be allowed, it will not cause any injustice on
the part of the plaintiff as well as the defendants. Therefore, I proceed
to pass the following order.
ORDER
1. Chamber Summons No.146/19 is hereby allowed as prayed for.
2. The advocate for applicant is hereby directed to carry out proposed
amendment in the main chamber summons within stipulated period.
3. Chamber summons no.146/19 is disposed of.
