O R D E R
This chamber summons is taken out by the applicant for
deleting the name of applicant no.2 in main chamber summons no.
1724/15. This Chamber summons is not resisted either on behalf of the
plaintiff or defendants. Read the present chamber summons and
chamber summons no. 1724/2015 and record.
2. By way of this chamber summons, the applicant had been

filed chamber summons no.1724/15 for making them as party in the
main suit. During the pendency of the said chamber summons,
applicant no.2Smita Chandrashekhar Kusurkar was murdered on
12/07/2018. ExhibitA is attached showing applicant no.2 was
murdered. Therefore, it is necessary to delete the name of applicant
no.2 in the main chamber summons no.1724/15. If the chamber
summons is to be allowed, it will not cause any injustice on the part of
the plaintiff as well as the defendants. Therefore, I proceed to pass the
following order.
ORDER
1. Chamber Summons No.143/19 is hereby allowed as prayed for.
2. The advocate for applicant is hereby directed to carry out proposed
amendment in the main chamber summons within stipulated period.
3. Chamber summons no.143/19 is disposed of.
